Zoomly Terms of Service

Welcome to Zoomly (“Zoomly”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the Zoomly mobile application, website, and related services (collectively, the “App”).
By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
- App Overview
1.1 Zoomly provides a technology platform that enables users to connect, communicate, and access transport-related services facilitated through the App.
1.2 We grant you a limited, non-transferable, revocable right to use the App in accordance with these Terms.
1.3 Zoomly acts as a technology facilitator only and does not directly provide transport or related services.
- Eligibility
2.1 To use the App, you must:
- Be at least 18 years old (or have guardian consent)
- Have legal capacity to enter into a binding agreement
- Provide accurate and complete information
2.2 We may suspend or terminate access if eligibility requirements are not met.
- User Accounts
3.1 You must create an account (“Account”) to access certain features of the App.
3.2 You are responsible for:
- Maintaining the confidentiality of your login details
- All activity conducted through your Account
- Keeping your information accurate and up to date
3.3 You must not share your Account or allow others to use it.
3.4 We may suspend or terminate Accounts for misuse, security risks, or breach of these Terms.
- Use of the App
4.1 You agree to use the App only for lawful purposes.
4.2 You must not:
- Use the App for fraudulent or misleading activities
- Interfere with or disrupt the App
- Circumvent fees, systems, or processes
- Attempt to extract data, reverse engineer, or exploit the platform
4.3 Communication through the App must remain respectful and appropriate.
- Payments and Fees
5.1 Certain services accessed through the App may require payment.
5.2 All pricing will be displayed prior to confirmation where applicable.
5.3 Payments are processed via third-party providers.
5.4 We may:
- Apply service fees or commissions
- Update pricing structures from time to time
5.5 You agree to pay all applicable fees associated with your use of the App.
- Cancellations and Refunds
6.1 Cancellation policies may apply depending on the service.
6.2 Refunds are handled in accordance with our policies and applicable law.
6.3 Disputes must be raised within a reasonable timeframe.
- Availability and Downtime
7.1 We aim to keep the App available at all times but do not guarantee uninterrupted access.
7.2 The App may be unavailable due to:

- Technical issues
- Third-party service failures
7.3 We are not liable for downtime outside our control.
- Privacy and Data
8.1 We collect and handle personal information in accordance with our Privacy Policy.
8.2 By using the App, you consent to the collection and use of your information.
8.3 You must only provide information you have the right to share.
- Intellectual Property
9.1 All intellectual property in the App is owned by Zoomly or its licensors.
9.2 You must not:
- Copy, reproduce, or distribute the App
- Reverse engineer or attempt to access underlying code
9.3 You grant us a licence to use any data or content you upload to operate the App.
- User Content and Conduct
10.1 You are responsible for any content you upload or share.
10.2 You must not post or transmit content that is:
- Illegal, offensive, or harmful
- Misleading or deceptive
- Infringing on others’ rights
10.3 We may remove content or restrict access at our discretion.
- Third-Party Services
11.1 The App may include links to third-party services.
11.2 We do not control or endorse third-party services and are not responsible for them.
11.3 Your use of third-party services is at your own risk.
- Liability
12.1 To the maximum extent permitted by law:
- The App is provided “as is”
- We do not guarantee accuracy, reliability, or availability
12.2 We are not liable for:
- Indirect or consequential loss
- Loss of data, profits, or business
- Issues arising from third-party services
12.3 Our total liability is limited to the amount paid by you (if any) for use of the App.
12.4 Nothing in these Terms excludes rights under the Australian Consumer Law.
- Suspension and Termination
13.1 We may suspend or terminate your access if:
- You breach these Terms
- Your use poses a risk to others
- Required by law
13.2 You may stop using the App at any time.
13.3 Upon termination, your right to use the App ceases immediately.
- Apple App Store (iOS Users)
If you access the App via Apple devices, additional Apple terms apply.
Apple is not responsible for the App and has no obligation to provide support.
- Dispute Resolution
15.1 You agree to attempt to resolve disputes with us in good faith before legal action.
15.2 If unresolved:
- Australian users: mediation in Australia
- International users: arbitration in Sydney
- Governing Law
These Terms are governed by the laws of New South Wales.
- General
17.1 We may update these Terms at any time. Continued use = acceptance.
17.2 You may not assign your rights without our consent.
17.3 If any part of these Terms is invalid, the rest remains in effect.
17.4 These Terms do not create any partnership, employment, or agency relationship.
